I don't think you can get banned for spamming someone. But you could spam and be serious in the game. I think you'd just get a warning.

It wouldnt be good admin judgement to give a warning to someone just spamming. But suspicions would be raised if the colony was un-developed.

But...you could play casually. Build structures, join alliances then spam him. 1 range 1 damage 1 armor anti whatever chassis he is using mech per spam. Pisses people off big time. Kill his spams and waste his shields

spamming can be seen as a EXP farming so it is bannable.
